In accordance with art. 52 of the Legislative Decree 6 September 2005 n. 206 (the "Consumer Code"), you have the right to withdraw from the contract signed with Dèpendance Srl (the "Seller") without any penalty and without giving any reasons, within 14 days from the day you received the products purchased on www .dependance.eu.
In accordance with art. 54 of the Consumer Code, you can exercise the right of withdrawal using, at your choice, one of the following methods:
a) by filling in the appropriate request form on the site (Profile page> Orders page> Specific order page / "Make Return" button);
b) sending by post to the Seller another explicit declaration of your decision to withdraw from the contract within fourteen (14) days of receipt of the products.
In case b) your declaration must be sent to the attention of Customer Service at the registered office of Dèpendance Srl, by e-mail to the e-mail address email@example.com It is understood that, in such cases, the burden of proving the correct and timely exercise of the right of withdrawal will be your responsibility.
In accordance with art. 57 of the Consumer Code, once the withdrawal from the contract has been exercised, the products to be returned must be delivered to the courier within fourteen (14) days from the date on which you informed the Seller of your decision to withdraw from the contract and in any case within fourteen (14) ) days from the date of receipt of the products themselves.
In accordance with art. 59 of the Consumer Code, the right of withdrawal is excluded in the event that you have purchased tailor-made or customized products or sealed goods that are not suitable for return for hygienic reasons or related to health protection and have been opened after the delivery.
1. CONDITIONS FOR THE EXERCISE OF THE RIGHT OF WITHDRAWAL IN COMPLIANCE WITH ART. 52 OF THE CONSUMER CODE
The right of withdrawal is exercised correctly if the following conditions are fully met:
a) the right of withdrawal must be regularly exercised within fourteen (14) days of receipt of the products by following one of the methods indicated above;
b) the products must not have been used, worn, washed and, in any case, must comply with the requirements indicated in art. 3, below, on the conformity checks of returned products;
c) the identification tag must still be attached to the products with the disposable seal which is an integral part of the item (see Article 5 below);
d) the products must be returned in their original packaging;
e) the returned products must be delivered to the shipper within fourteen (14) days from when you notified the Seller of your decision to withdraw from the contract;
f) the products must not be damaged.
If you have complied with all the required conditions, the Seller, in accordance with art. 56 of the Consumer Code, will reimburse you in full the price of the products purchased, remaining at your expense only the costs of the return, i.e. those for returning the purchased products to the Seller, unless the Seller has expressly exempted you from such expenses to the at the time of purchase and on the additional condition that you use the forwarder and the shipping methods suggested by the Seller in the following paragraph 2.
2. METHOD FOR RETURNING PRODUCTS TO THE SELLER
Once the Seller has agreed and confirmed the return of the item (s) with you, he will send you by e-mail (to the e-mail address used to register the account) an e-mail from the Express Courier containing the date of the withdrawal (it will be possible to modify it by following the instructions) and a pre-printed adhesive label showing the shipping address; you will not have to pay the costs of the return in person, the Seller will in fact pay the courier on your behalf, withholding a lump sum from your refund equal to the cost previously incurred for the delivery of the purchased products to your home. This shipping method also allows you to check, at any time, where each package is, freeing you from any liability in case of loss or damage to the products during transport. If, on the other hand, you decide to use a shipper other than the one made available by the Seller, you will have to pay the return costs in person and you will be responsible for any loss or damage to the products during transport. It is understood that, in this case, an amount equivalent to the cost of standard shipping of the purchased products will also be refunded, while, in accordance with art. 56, paragraph 2, of the Consumer Code, any additional costs incurred by you for choosing a different and / or faster type of shipment and delivery than the standard one will not be reimbursed.
The Seller will in fact verify the compliance of the products with the conditions and terms indicated above as soon as it has received the products at its warehouses and will inform you via email in case of acceptance of the return.
Couriers and return shipping costs:
If, on the other hand, you choose to entrust your return to another courier or postal service other than the one offered by Dèpendance, the shipping costs will be at your expense, in accordance with our instructions for making the return, and you will be responsible in case of losses and damage during transport. There are no other deductibles for reimbursement than listed above. For your protection, we recommend that you use a courier in case you do not want to use the prepaid return service.
3. VERIFICATIONS OF CONFORMITY OF RETURNED PRODUCTS
You will be contacted if your return cannot be accepted because it does not comply with the conditions referred to in lett. a) and e) of the previous paragraph 1 or in the hypothesis referred to in art. 59 of the Consumer Code and you can choose to have the purchased products back at your expense. If you refuse this shipment, the Seller reserves the right to keep the products and the amount corresponding to the purchase price of the products.
All products must be returned new and unused, in perfect condition, with all protective materials and with identification tags and stickers attached to the products (if any), as well as their packaging, accessories and documentation. If the product shows signs of use or if it has been used or altered from its original condition in any way, the Seller reserves the right not to accept the return or, alternatively, to reduce the amount of the refund or exchange. Consequently.
For example, the Seller may make a reduction in the refund in the following circumstances:
• the products have been used, worn, damaged or washed;
• the identification tag is no longer attached to the products with the disposable seal or has not been returned. Please note that the identification tag is an integral part of each product; and / or
• the original packaging which is an integral part of the product has not been returned (eg the protective bag);
You will be contacted if the Seller decides to reduce the refund for this reason. In this case, you can choose (as an alternative to the reduction of the refund) to have the purchased products back at your expense.
In the latter case, if you refuse the shipment, the Seller will have the right to withhold the products and the amount indicated for the reduction of the refund, due to the decrease in value of the returned products.
4. REFUND TIMES AND METHODS
After the Seller has received your return and checked that all the requirements have been met, you will receive an email confirming acceptance of the return and Dèpendance will proceed with the full refund, or, if the existence of a decrease in value of the returned products is found , you will receive an email in which you will be informed of the amount deducted by way of reduction of the refund and Dèpendance will refund the amount due. Whatever payment method you use among those available, the refund is activated by the Seller as soon as possible, and in any case within fourteen (14) days from the date on which you became aware of the exercise of your right of withdrawal, once it has been verified that the withdrawal took place in compliance with the above conditions.
The actual time for crediting or returning the amounts you paid for the purchase of the products depends on the payment methods used:
• purchase by credit / debit card: the repayment time depends on the credit / debit card management company, but usually takes place within two account statements. We remind you that the value date of the re-credit is the same as the debit, so you will not suffer any loss in terms of bank interest;
• purchase via PayPal (if available): the refund will be made to your PayPal account and will be immediately visible. The actual refund on the credit card from your PayPal account depends on the institution that issued the card;
cash on delivery (if available): the refund takes place on the current account indicated by you, therefore the refund time depends on the correctness of the data you enter; the re-credit normally takes place within fourteen (14) days.
5. PRODUCTS WITH DEFECTS OR NON-CONFORMING
Without prejudice to the application of the mandatory rules for consumer protection, you can return a product because it is affected by defects or does not comply with the order, informing the Seller, within thirty (30) days from the day you received the products purchased on www. dependance.eu, using the Return Form found in the Customer Service area.

Dèpendance will check the products you have returned because they are affected by defects or do not comply with the order and will proceed with the full refund, including shipping costs and the expenses you have incurred to return the products to Dèpendance.
In the event that Dèpendance does not detect any defect or lack of conformity in the returned products, you will be informed that your return will not be accepted and you can choose whether to have the purchased products back. If you refuse the shipment, Dèpendance will have the right to retain the products and the amount corresponding to the purchase price of the products, as well as reserves the right to request the costs incurred.
6. CONDITIONS FOR THE EXCHANGE OF PRODUCTS
In some cases, as specified below, you will have the possibility to change the products purchased with others of the same model, having different size and / or color. The exchange of products will be possible only if the products in the selected size and / or color are available at the Seller's warehouses.
The exchange request will take place within the limits set out below:
• only those products purchased, for which this possibility will be expressly provided for in the Return Form, can be exchanged;
• you can request the exchange of one or more products purchased only with products of the same model, with different size and / or color. In any case, the options available for the exchange will be indicated in the Return Form;
• you can request the exchange of one or more products purchased no later than fourteen (14) days from the date of their delivery, by completing the Return Form, to be sent electronically to Dèpendance within the aforementioned term. The products to be changed must be delivered to the courier within fourteen (14) days from when you notified the Seller of your decision to change the products;
• you can make only one exchange request for each product purchased;
• the products for which you request the change must be returned to DÈPENDANCE in their original packaging, unused, worn, washed or damaged, and the identification tag must still be attached with the disposable seal;
• the products to be exchanged that are part of a single order must be sent to DÈPENDANCE in a single shipment. DÈPENDANCE, in fact, reserves the right not to accept products from the same order, sent for exchange at different times.
If all the aforementioned conditions are correctly respected, once the Return Form containing your exchange request has been completed and sent, DÈPENDANCE will process the same replacement request by sending you a confirmation email for this purpose.
After DÈPENDANCE has received the products you intend to change and checked that all the above requirements have been met, DÈPENDANCE will check the actual availability in its warehouses of the products in the size and / or color you have selected.
In the event that the product or products selected for the exchange are not available in its warehouses, DÈPENDANCE will not be able to accept your exchange request and will therefore proceed to refund the price of the product or products originally purchased and not replaceable, in accordance with what provided for by the Consumer Code and in the manner provided above.
In the event that the product or products selected for exchange are available, DÈPENDANCE will be able to accept your exchange request and will therefore send you an email confirming the shipment of the replacement products. In this case, the shipment will take place within thirty (30) working days from the date on which DÈPENDANCE becomes aware of your exchange request. The shipping costs of the replacement products will be borne by DÈPENDANCE.
If the price of the purchased product is lower or higher than the price of the product selected for the exchange, you will not be entitled to any refund and / or charge for the difference. However, it is understood that, as an alternative to the request for product replacement, you can exercise your right of return in accordance with the Consumer Code.
You will be contacted if your exchange request cannot be accepted because it does not comply with the above conditions. In this case, you can choose to get back the products you intended to exchange at your expense. If you refuse this shipment, DÈPENDANCE reserves the right to keep the products and may also withhold the amount corresponding to the purchase price of the products themselves, or the amount indicated for the reduction of the refund, due to the decrease in value of the returned products, as indicated above.
The replacement product or products may be subject to subsequent return pursuant to art. 52 of the Consumer Code.
7. PRODUCT IDENTIFICATION CARD
We remind you that all products offered for sale by the Seller are equipped with an identification tag attached with a disposable seal, which is an integral part of the goods. We therefore remind you to try the product without removing the tag and its seal, because returned products that do not have them will not be accepted.
8. CONSUMER CODE
These Conditions for exercising the right of withdrawal, which are an integral part of the General Conditions of Sale, are governed by Italian law and in particular by the Consumer Code.
