Conditions of sale

The following General Terms and Conditions of Sale govern the offer and sale of products on our website ("www.dependance.eu "). The products purchased on www.dependance.eu are sold directly by Dèpendance S.r.l. (the “Vendor”), company with registered office in Italy at Via Giolitti 24 – 10123, Iscr. Reg. Imp., C.F. e P.IVA n. 12330250015. Requests for information should be made through our Customer Care service. For further assistance, please go to our Customer Care area where you will find information on orders, shipping, refunds and returning products purchased on www.dependance.eu. Remember that you can always contact the Vendor through Customer Care. 1. OUR BUSINESS POLICY

1.1
The Vendor offers products for sale on www.dependance.eu and its e-commerce business services are available exclusively to its adult end users, i.e. "consumers".

1.2
“Consumer" means any individual who is acting for purposes outside of his or her trade, business or profession. If you are not a "consumer", please do not buy any products on www.dependance.eu .

The Vendor reserves the right not to accept orders received from users who are not "consumers".

1.4
These General Terms and Conditions of Sale exclusively regulate the offer, transmission and acceptance of purchase orders relating to products on www.dependance.eu between the users of www.dependance.eu and the Vendor.

The General Terms and Conditions of Sale do not apply to the provision of services or the sale of products by third parties that are present on www.dependance.eu via links, banners or other hypertext connections. Before sending orders and purchasing products and services from third parties, we recommend that you verify their terms and conditions. Under no circumstances shall the Vendor be deemed liable for the supply of third party services or for the execution of e-commerce transactions between users of www.dependance.eu and third parties.

2. HOW TO PLACE AN ORDER, AND OUR CONTRACT WITH YOU

2.1
To place an order for one or more products on www.dependance.eu , you must fill out the online order form and send it electronically to the Vendor, following the relevant instructions.

Before proceeding to purchase your products, we ask that you carefully read the General Terms and Conditions of Sale and the Return Policy. You may wish to print a copy using the print option and keep it safe for your own personal use.

2.3
On the order confirmation page, which appears just before the completion of your order, and which contains a reference to the General Terms and Conditions of Sale and the Return Policy, we will provide you with a summary of the main characteristics of each product ordered, the price (including all applicable fees and taxes), and the cost of shipping (including any additional fees you may be charged if you choose shipping that is faster than and/or different to standard shipping).

2.4
When you proceed with submitting the order form, you will be notified that sending it requires you to pay the price indicated therein. Before submitting the order form, you will be asked to identify and correct any possible input errors.

The order form sent to the Vendor will be filed in our database for the time required to process your order and as stated by law. You may access your order form in the 
My Order section.

2.6 English is the language used for finalising the contract with the Vendor.

2.7
After your order form has been submitted, the Vendor will process your order. Following placement of your order, the Vendor will send you an automatic acknowledgment of receipt. However, this does not constitute acceptance of your order by the Vendor nor does a contract between you and the Vendor exist at this point in time in respect of your order. The Vendor's acceptance of your order will take place when the Vendor emails you to confirm that the order has been dispatched, at which point a contract will come into existence between you and the Vendor. The acceptance email represents an electronic purchase order receipt and contains the General Terms and Conditions of Sale, a summary of the Return Policy, and all relevant information relating to your order.

2.8
If the Vendor is unable to accept your order for any reason (including any of the reasons described in section 2.9 or if a product is out of stock), the Vendor will inform you of this.

2.9
The Vendor is also entitled to cancel your order, even after accepting it, in the following circumstances: the Vendor has identified an obvious and unmistakeable error in the price or description of the product; the Vendor suspects illegal or fraudulent activity; or you have not complied with these General Terms and Conditions of Sale. If so, the Vendor will notify you as soon as possible of such cancellation and require you to return the products if they have already been delivered to you.

2.10
By submitting an order form, you unconditionally accept and undertake to observe the provisions of these General Terms and Conditions of Sale in your contract with the Vendor. Should you not agree with certain provisions of these General Terms and Conditions of Sale, please do not submit your order form for the purchase of products on www.dependance.eu.

By submitting an order form, you agree and accept these General Terms and Conditions of Sale as well as further conditions contained on www.dependance.eu , including those accessed via links, and including the 
General Terms and Conditions of UsePrivacy Policy and the Return Policy.

3. GUARANTEES AND PRODUCT PRICE INDICATION

3.1
The website www.dependance.eu exclusively sells Dèpendance branded products purchased directly by the Vendor from the fashion house and/or authorised manufacturers.

3.2
The Vendor does not sell second-hand products, flawed products or products of lower quality than the corresponding market standards.

3.3
The main characteristics of the products are shown on each product page on www.dependance.eu . The images and colours of the products offered for sale on www.dependance.eu may not correspond exactly to the true garments due to the Internet browser or monitor used.


3.4
Prices are subject to change. Please check the final price before sending your order form. In the event of a recognizable error in the indication - by the Vendor - of the product price or calculation of the amount requested at payment, the Vendor will reject the order and contact the user to offer them the opportunity to purchase the product(s) at the correct price.



3.5
The Vendor cannot accept purchase requests from countries not listed on the splash page.

3.6
All products come with an identification tag with a disposable seal attached.

3.7

All products sold by the Seller are covered by the legal guarantee of twenty-four (24) months for lack of conformity, in accordance with the applicable law. The lack of conformity of the product must be communicated to the Seller within two (2) months of its discovery. The lack of conformity can be communicated to the Seller by contacting Customer Service. In case of lack of conformity you have the right to request the repair or replacement of the product. In the event that the aforementioned remedies are not possible or excessively burdensome, you will be entitled to a reduction in the price paid or the termination of the sales contract, pursuant to art. 130 of the Consumer Code

4. PAYMENT

4.1
Payment of the price of the products and the costs of their shipping and delivery must be made using one of the methods indicated on the order form. Under no circumstances will you be charged more than the cost incurred by the Vendor relative to the payment method chosen by you.

4.2
In the case of payment by credit/debit card, all details (for example, card number or expiration date) will be sent via an encrypted protocol to the banks which provide remote electronic payment services to the Vendor, without third parties having any access whatsoever thereto. These details will not be used by the Vendor except for carrying out procedures relevant to your purchase, or issuing refunds in the case of returns, subsequent to the exercise of your right to return, or for reporting cases of fraud on www.dependance.eu to the police or other authorities. The price for the purchase of products and the costs for their shipping and delivery as indicated on the order form will be charged to your account at the moment in which the purchased products are shipped.

4.3
In case of payment by bank transfer, the waiting time is 5 working days from the creation of the order; following non-receipt within this period, the Seller may independently cancel the order. In case you want to keep the order valid but are late with the payment, please communicate it through the Customer Service

8. PRE-ORDERED PRODUCTS

 

8.1

Whatever the payment method used by you, the refund due, in whole or in part, is activated by the Seller, in the shortest possible time and in any case within fourteen (14) days from the date on which the Seller became aware of the exercise of your right of withdrawal after verifying the correct execution of your right of withdrawal and checking the returned products.

 

8.2

The Seller reimburses using the same payment method used by you for the purchase of the returned products, unless you have expressly agreed with the Seller to use a different means of payment and on condition that you do not have to incur any costs. further as a consequence of the reimbursement. If there is no correspondence between the recipient of the products indicated in the order form and who made the payment of the sums due for their purchase, the reimbursement of the sums, in case of exercise of the right of withdrawal, will be carried out by the Seller, in in any case, towards the person who made the payment.

 

8.3

We remind you that the value date of the re-credit is the same as the debit; consequently you will not suffer any loss in terms of bank interest.

 

 

9. PRIVACY POLICY

9.1

In some cases, the Seller may offer you the opportunity to preview one or more items not yet available for purchase on www.dependance.eu and belonging to the next collection. Products that can be purchased in pre-order will be marked with a special label on the product sheet. The Seller will indicate for each item the estimated shipping date and in any case will send you a confirmation email when the package will be shipped. In the event that your purchase order contains both items already available and items in pre-order, the products will be shipped at two different times, but the shipping costs will be charged only once. In the case of a purchase order that contains only pre-order items but with different shipping dates, the products will be shipped all together on the last estimated shipping date.

 

9.2

Please note that the purchase of pre-order products can only be made by credit card. The Seller will not request payment from your bank until the ordered items have been shipped. At the conclusion of the order, the Seller will ask your bank to verify the data entered; the validity of your card could be confirmed through a payment authorization of 1 Euro. This authorization is not a charge: your credit card will only be charged at the time of shipment.

 

9.3

Except as otherwise provided in this paragraph 9, these General Conditions of Sale are fully applied to products purchased in pre-order.

 

10. GOVERNING LAW AND DISPUTE RESOLUTION

 

10.1

Without prejudice to the application of the mandatory rules of European derivation to protect the consumer, the General Conditions of Sale are governed by Italian law and in particular by the Consumer Code and Legislative Decree 9 April 2003, n. 70 ("Implementation of Directive 2000/31 / EC relating to certain legal aspects of information society services in the internal market, with particular reference to electronic commerce").

 

 

10.2

In the event of disputes between the Seller and each end user, arising from the General Conditions of Sale, the Seller guarantees, as of now, full adherence and acceptance of the RisolviOnline conciliation service. RisolviOnline is an independent and institutional service, provided by the Chamber of Arbitration of the Turin Chamber of Commerce, which allows you to reach a satisfactory agreement, with the help of a neutral and competent conciliator, on the Internet. 10.3

We also inform you that the European Commission provides a platform for the alternative extra-judicial resolution of disputes, accessible on the website http://ec.europa.eu/odr.

 

10.4

For all disputes relating to purchase orders and / or these General Conditions of Sale, the Court of Turin will be competent.

 

 

12. AMENDMENTS AND UPDATES

The General Terms and Conditions of Sale (including the Returns Policy) may be amended from time to time. Any changes are effective as of the date of publication on www.dependance.eu and will apply to any new orders you place following the date of publication.
